In the court below, the plaintiff in error filed a complaint against the defendant in error to recover on a check drawn by the latter in favor of the former. The answer *291admitted the check, but denied that it had been given for value, and for a further answer it was alleged that the defendant McCarthy was the owner of certain household property; that the plaintiff Norman served a writ of attachment running against another party in a suit that had been commenced before a justice of the peace, and took possession of the said property of McCarthy by virtue of the writ; that McCarthy thereupon…
