Plaintiff in error was found guilty in the court below of the crime of burglary. Motions for a new trial and in arrest of judgment were overruled, and he was sentenced to the penitentiary for a term of not less than one year. To reverse that judgment this writ of error is prosecuted.

The indictment is of two counts, charging burglary and larceny. The first avers that the defendant “forcibly broke and entered a certain building then and there owned, used and occupied by John Alberts as a chicken-house, with intent to steal, and did steal, two chickens, of the value of sixty cents.” The second…
