—In an action, inter alia, to recover damages for employment discrimination in violation of Executive Law § 296, the defendant appeals from an order of the Supreme Court, Richmond County (Gigante, J.), dated March 7, 2002, which denied its motion for summary judgment dismissing the cause of action to recover damages for employment discrimination in violation of Executive Law § 296.
Ordered that the order is reversed, on the law, with costs, the motion is granted, and the cause of action to recover damages for employment discrimination in violation of Executive Law § 296 is dismissed.
