Defendant appeals from the order denying its motion in the alternative for judgment notwithstanding the verdict or a new trial.
The action was for damages sustained by plaintiff, a boy a few days under six years of age, when an electrically operated bus, through the alleged negligence of defendant’s driver, struck the boy on Piedmont avenue, in West Duluth, crushing his left leg so that it had to be amputated a couple of inches below the knee.
