The complaint urged in this ■court by counsel for and on behalf of the defendant is that the district judge improperly refused to allow them to withdraw a plea of guilty to “cutting and stabbing with a dangerous weapon with intent to kill,” which accused had been permitted to enter in lieu of his original plea of not guilty to a charge of “willfully, feloniously, and of his malice aforethought cutting and stabbing one Jack Sinegaul with intent to kill and murder,” and to allow him to enter a plea of not guilty, In order to be tried by a jury. The plea sought to be withdrawn had been accepted…
