ENOCH, Chief Judge.
Defendant was convicted of escape and six counts of being an habitual criminal, and appeals the denial of his motion to dismiss, alleging that his statutory speedy trial rights were violated. We affirm.
Defendant was charged with escape from the Colorado State Penitentiary, and with six counts of being an habitual criminal. On March 6, 1979, he pled not guilty and asserted his statutory right to a speedy trial and his right to disposition of detainers pending against him. Trial was then set for May 23, 1979.
