It appears from the record in this case that James Tazwell died, in the year 1871, seized of the real estate involved in this litigation. He left surviving him Euphemia, his-widow, and James and William Tazwell, and Elizabeth J. B. Wilton, his only children and heirs at law. In 1874 James sold to William his interest in the lands and the latter thereby became invested with two-thirds of the title. But the premises were subject to the dower and homestead rights of the widow, which had not been allotted to her. In September, 1874, William and Elizabeth filed their petition for partition against…
