This is an appeal from an order of the district court of Leavenworth County denying petitioner — who is presently serving an unexpired sentence in the penitentiary for grand larceny —a writ of habeas corpus. The facts of record required to dispose of the decisive issues presented by the appeal will be stated briefly.
