This case presents an interesting practice question which arises as follows. In May, 1957, plaintiff in error Rutledge sued defendants in error, Swindle and Searcy, individually, and doing business as Refrigeration Rental Supply Company, in the General Sessions Court of Davidson County for unliquidated damages in the amount of $1,500. They did not defend *484the suit in that court and judgment was entered for $700 on June 10, 1957.
