I find myself unable to assent to the judgment in this case for the following reasons. e

1. In my opinion there was error in overruling the defendant’s challenge of the juror Haley. I agree that in so far as section 217 of the Code is concerned, the juror, even if he may be regarded as “a salaried officer of the United States,” in a technical sense, had merely a right to claim exemption from jury duty thereunder. It was not a positive disqualification, which required him to be set aside without his claiming the exemption. I think, however, that the objection went further than this, and…
