— Plaintiff brought an action in equity and sought an accounting against his sister and brother-in-law claiming he was entitled to a one-half interest in the profits from the operation of an apartment house in Sioux City, as well as a one-half interest in the proceeds received from the sale of it. The defendant Frank A. Barnick, the brother-in-law, in his answer denied the claims of the plaintiff and contended the plaintiff in no manner had acquired a partnership interest.
