An action was brought in a justice’s court by a physician, on an open account for professional services rendered to an ■employee of the defendant. The plaintiff testified that he was employed by the defendant to render the services, and that the de*784fendant expressly agreed to pay for them. The defendant denied this, and contended that the services were rendered, not to him, but to his employee. Several witnesses were introduced.
