Appeal from Municipal Court, Borough of Manhattan, Second District. Action by Isaac Dolinsky against the Brisker Unterstuetzungs Verein. From a default judgment, defendant appeals. Judgment vacated, and cause remanded.

1Per curiam

It is unnecessary to pass upon the validity of the judgment entered in this action, but the defendant’s default should have been opened under the provisions of section 253 of the Municipal Court Act (Laws 1902, c. 580). Review & Record Co. v. Gilbreth, 65 Misc. Rep. 503, 120 N. Y. Supp. 100. Judgment vacated, default opened, and case set down for trial on the 30th day of June, 1914, with costs to appellant to abide the event.
