This was a complaint filed by the appellants,' to restrain the treasurer of Shelby county from the collection of taxes upon the duplicate in his hands for collection, for the construction of a gravel road or turnpike.

The complaint shows that certain persons filed a petition in the office of the auditor of Shelby county, asking the commissioners of that county to grant to them the right of a highway.
