The plaintiff in error, the Farmers Manufacturing Company, applied to the late firm of T. W. Godwin & Co., of which the defendant in error, A. L. Woodworth, is the surviving partner, to manufacture for it an amusement device called a “Revolving Parachute,” the general design of which is described as follows: “A circular platform was to be elevated by means of a revolving upright screw, or shaft, driven by electric power applied to machinery at its base.
