The appellant, Allan Andrew Fuller, was convicted of manslaughter. He was sentenced to 20 years in prison.

The state's evidence showed that Joe Floyd was found dead in his yard on the evening of April 3, 1989. He had been shot in the chest. The appellant's father-in-law, William Day, testified at trial that the appellant told him right after the shooting that he had shot Floyd. Day tried to convince the appellant to call the police, but he refused; therefore, Day informed the authorities about the shooting. Day testified that the appellant had been drinking but that he was "acting all right"…
