The plaintiffs are real estate agents. Negotiations were pending between the defendant and one Mary E. Haley for the exchange of certain lots claimed by them respectively. At the same time there was an agreement between the plaintiffs and the defendant as to the payment of a certain sum as commissions on the transaction. What the terms of that agreement wese is uncertain under the evidence. The plaintiff, McCann, admitted on his cross-examination that no commissions were to be charged unless the trade was consummated.
