Appeal from an order of the Supreme Court (Teresi, J.), entered November 4, 1994 in Albany County, which denied motions by defendant and third-party defendant for summary judgment dismissing the complaint and third-party complaint.

Plaintiff, who was employed by third-party defendant as an interior painter, fell from a ladder to the ground while performing painting work in the course of her employment in connection with the construction of premises owned by defendant.
