Appeal from Dubuque District Court. — D. E. Maguire, Judge. Dependant was tried to a jury, aud convicted of the crime of manslaughter, and judgment pronounced. Defendant appeals.

1. HcmcrDfi: nonpositive, identification of accused. Defendant was accused of causing the death of one George Parios, on September 30, 1918, by shooting. There were three bullet wounds in the body of deceased, in front and to the left: one near the collar bone, another an inch below the left nipple, and the third in the abdomen. No question is made but that the wounds were the cause of his death. The shooting occurred between 7 and 8 o’clock in the morning.
