Cropper, J.), rendered May 2, 1988, convicting defendant, upon a plea of guilty, of criminal possession of stolen property in the fourth degree, and sentencing him to a definite prison term of eight months, unanimously modified, on the law, the facts and as a matter of discretion in the interest of justice, to vacate the sentence, the matter remanded for resentencing, and otherwise affirmed.
