Journalist Jerry Capeci applied on January 11, 2005 for an order directing the government to make copies of five tape recordings introduced into evidence during the trial of United States v. Massino, No. 03 Cr. 307 (“Massino I ”) available to him and to any other member of the press who requests similar access. 1 The Government responded on January 19, 2005, opposing Capeci’s application and requesting a protective order precluding the duplication of the requested recordings.
