At the May, 1926, term of the Circuit Court of Rock-bridge county, Isaac Weinberg brought an action against the First National Bank of Lexington to recover the siim of $14,595.21. The notice of motion alleges:
“The above mentioned net balance of $14,595.21 due to the undersigned has been caused and brought about by the errors, discrepancies and falsifying the accounts of *435the undersigned with the said First National Bank of Lexington, Virginia, by its agents, servants, cashiers, assistant cashiers, bookkeepers or tellers, or all of such agents and servants combined.”
