Appeal from, Cerro Gordo District Court. Action at law. Tbe pleadings and facts of tbe case are fully set out 'in the opinion. There was a judgment upon a verdict for defendants, plaintiff appeals.

I. As a question in the case involves the pleadings, it becomes necessary to set them out fully. The material parts of the petition allege:

“That on or about the first day of August, 1879, plaintiff by and through their managing agent, J. E. Ilarkness, made and entered into a parol agreement with defendants, whereby defendants were to receive and keep on deposit the various sums of money which plaintiff might from time to time send them, for the purchase of flax seed, and that the same should be paid out only upon the certified tickets of J. II. Yalentine, issued by him only for- the purchase…
