Mark Gennardo, petitioner-appellant, filed a post-conviction petition to vacate his conviction and six years’ imprisonment sentence for an unlawful delivery of cocaine and for a new trial. The petition alleged that the State failed to comply with the mandate of Brady v. Maryland (1963), 373 U.S. 83, 10 L. Ed. 2d 215, 83 S. Ct. 1194, and Brady’s progeny to furnish to petitioner’s trial counsel evidence favorable to petitioner.
