HARPER, Judge.

—This is the second appeal in this case. On this trial appellant was found guilty, and his punishment assessed at ten years confinement in the State penitentiary.

The only bills of exception in the record complain -of the action of the court in overruling appellant’s application for a continuance, which will hereinafter be discussed. The only other ground in the motion for a new trial alleges the insufficiency of the testimony to sustain the verdict. The evidence introduced in behalf of the State, if believed, fully supports the findings of the jury. The issues made by the…
