Appeal by the defendant, by permission, from an order of the Supreme Court, Kings County (Dowling, J), dated November 26, 2003, which denied, without a hearing, his motion pursuant to CPL 440.10 *660to vacate a judgment of the same court rendered February 18, 1997, convicting him of attempted murder in the second degree (four counts), criminal possession of a weapon in the second degree, and assault in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the order is affirmed.
