This is a child custody case regarding the conservatorship of two children, R.H. and D.T.H., whose mother passed away. Appellant, Anwar Rolle, is the children’s maternal uncle, and he petitioned the trial *408court to name him the sole managing conservator of the children. The children’s father, Derick LeJohn Hardy, who was a joint managing conservator of the children at the time of their mother’s death, moved to dismiss Rolle’s suit on the basis that he could not establish standing to maintain his claim.
