The point to be decided in this cause is whether a demurrer filed to the amended petition should he sustained or overruled. In other words, under the allegations of the amended petition, is the plaintiff entitled to the relief prayed for, which is that a writ of mandamus issue against the respondent, the clerk of the council of the city of Lakewood, Ohio, requiring him substantially to perform the duties imposed upon him by Sections 8 and 9, Article XVIII, of the Constitution of Ohio, and Section 5, Article 18, of the charter of the city of Lakewood, requiring that he mail a copy of the…
