BACKGROUND

Said Solimán brought federal and state age discrimination claims against his former employer, Digital Equipment Corporation (Digital), alleging disparate treatment (Count I) and disparate impact (Count II). 1 Solimán began working at Digital on February 11, 1985, as an accountant. In November of 1990, Digital gave Solimán, who was then fifty-nine years old, a Transition Financial Support Option (TFSO) as part of a plan to achieve a voluntary reduction of Digital’s workforce.
