Highland House, Inc., filed a voluntary petition for reorganization, see 11 U.S.C. §§ 1101-1174, under the federal bankruptcy code, see 11 U.S.C. §§ 101-1330, and a little more than a year later filed its amended joint plan of reorganization. That plan, as relevant here, provided that any executory contracts not listed on a particular schedule would “be deemed rejected by the Debtors pursuant to [11 U.S.C. § 365].” A short time after the plan was filed, the bankruptcy court entered an order stating that all claims on rejected executory contracts had to be made by September 2, 1992, or they…
