The questions here arise upon motions by the respective defendants to dismiss the bill of complaint. Plaintiff, a citizen and resident of the state of Hlinois, brought the action to establish his right to 40 shares of the preferred stock of the Missouri Pacific Railroad Company, held in trust by the defendant the Central Union Trust Company, which the said company refuses to deliver to him solely because of a claim on the part of the Alien Property Custodian, arising from the service by the Alien Property Custodian of an alleged demand upon the Central Union Trust…
