Conspiracy to Traffic in Cocaine — Merger with Substantive Crime. James Marion Moser was charged with two counts of selling and possessing cocaine and one count of conspiracy to traffic in cocaine. Count I alleged the distribution of cocaine on July 8, 1984. Count II alleged trafficking in cocaine by possessing a stated quantity with intent to distribute on July 17, 1984.
