Order, Supreme Court, New York County (Ira Gammerman, J.), entered June 13, 2001, insofar as it dismissed *326defendant Labendz’s cross claims against a codefendant and guarantor, unanimously reversed, on the law, without costs, and the cross claims reinstated.

Defendant Vinderboim and defendant Labendz equally share ownership of the corporate defendants. Vinder, Vinderboim’s son, took assignment of a defaulted loan on which defendants are alleged to be liable either as obligors or guarantors.
