ESCHBACH, Circuit Judge.

The primary question presented in this appeal is whether the failure of petitioner’s counsel to move to quash the arrest of petitioner constituted ineffective assistance of counsel under the Sixth Amendment. The district court concluded that it did not and denied the petition for federal habeascorpus relief. For the reasons stated below, we will affirm.
