WARRINGTON, Circuit Judge.

This is a petition to revise in matter of law an order of injunction made by the court below against Hofer, staying for a period of 12 months the sale of certain lands, situated in Burleigh county, N. D., under a decree of foreclosure theretofore obtained by him in the district court of that county against David Rohrer and Ada V. Rohrer.

The validity and priority of petitioner’s mortgage lien are admitted. All statutory steps having been taken to give to the court jurisdiction both of-the lands and the parties (Rev. Codes N. D. [Ed. 1905] §§ 6837, 6843, 6845, 6848),…
