The plaintiff is the owner in fee of lands in the city of Brooklyn, over and through which Butler-street, sometimes called Harrison-street, had heretofore been laid out, but not opened for use under the usual proceedings for that purpose. The defendants, Gamaliel King, John H. Funk, Daniel L. Northrop, and William B. Lewis, are the *181commissioners of sewerage and drainage in the city of Brooklyn, under the act of the 15th April, 1857, and the act amending the same, concerning sewerage and drainage, in such city.
