MEMORANDUM OPINION AND ORDER

DAWSON, District Judge.

The Plaintiffs instituted this action in state court, seeking to recover insurance proceeds under a policy issued by Defendant for certain property owned by Plaintiffs that was destroyed by fire. Defendant removed the action to this Court based on diversity jurisdiction. (Doc. 1.) Currently before the Court are the parties’ cross-motions for partial summary judgment. (Docs. 9, 12.)
