The appeal in this case is from the action of the Court below in sustaining the demurrer to a declaration in slander.
The appellant, in its declaration alleged that “it is now and was on December 12th, 1913, the sole manufacturer of a tooth paste known as the ‘A. 0.. Reynolds Tooth Paste;’ that at great expense the plaintiff has advertised the said tooth paste as the ‘A. O. Reynolds Tooth Paste,’ and by that name it is now and was on December 12th, 1913, known and sold to the public.
