This matter is before the Court upon plaintiff’s class action complaint requesting declaratory and injunctive relief against defendant Otis Bowen, Secretary of Health and Human Services (HHS) in claims II and III of the amended class action complaint. (Doc. No. 27). The parties have agreed to submit this matter to the Court upon cross motions for summary judgment without oral hearing.
