This is an action to recover damages for personal injuries and wrongful death. The facts of this case are set forth in more detail in the decision of this court dated May 6, 1985 (McDaniel v Clarkstown Cent. School Dist. No. 1, 111 AD2d 151). For the purposes of this motion only, it is not disputed that the court *350correctly found that plaintiff’s decedent, who was injured in 1972, and who subsequently died, allegedly as a result of those injuries, was contributorily negligent as a matter of law.
