Lovins, Judge:

This action was instituted in the Circuit Court of Brax-ton County, West Virginia, by John Holiman, Administrator of the Estate of Jacob R. Wiley, against the Baltimore and Ohio Railroad Company, a corporation, and Woody H. Mullen.

The purpose of the action is to recover for the death of the plaintiff’s decedent, caused by a collision between a motor vehicle and a locomotive at a railway crossing. The jury rendered a verdict against the defendants in the sum of $10,000.00. The trial court, after overruling a motion to set aside the verdict, entered judgment on the verdict. This…
