— This is an action for damages, based on the refusal of the defendant corporation to recognize-plaintiff’s ownership of ten shares of its capital stock.

The material facts, in so far as concerns this case, may be stated as follows: In February, 1892, Watson, as president of a bank at Salina, Kansas, loaned $5,000 to one M. C. Curtis, who was then assistant; cashier of the American National Bank at Kansas City..
