Ejectment, brought by Andrew 0. Morris against Robert L. Taylor, in the New-Yorlc common pleas, for an undivided fourteenth of a lot of land in that city. On the trial in the common pleas the case was this: Andrew Morris, the grandfather of the plaintiff below, died in 1828 seized in fee of the whole of the premises in question, having first made and published, in due form, his last will and testament, as follows : “ I Andrew Morris, of the city of New-York, do make this my last will and testament, revoking any I may have heretofore made.
