Tbis is an action upon a policy of insurance insuring tbe life of Fayette R. Gridley in tbe sum of $10,000, for tbe benefit of bis wife, tbe defendant in error.

Tbe policy sets forth that it was issued “ in consideration of tbe representations made in tbe application tberefor and of the premium,” &c. It sets forth, further, that “ if any of tbe statements or declarations in tbe application for tbis policy, and upon tbe faith of which it is issued, shall be found in any material respect untrue, then . . . tbis policy shall be null and void.”
