MEMORANDUM AND ORDER

WEXLER, District Judge.

Petitioner pro se Melvini James, has applied for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. For the reasons set forth below, petitioner’s application is denied.

PROCEDURAL BACKGROUND

James was convicted, after a jury trial in County Court, Nassau County, of one count of murder in the second degree and two counts of assault in the first degree. Petitioner was sentenced on February 2, 1982, to an indeterminate term of 18 years to life for murder and two indeterminate terms of 4 to 12 years for assault, all sentences to run concurrently.
