This is an appeal from an order made by the City Court of Watertown directing the destruction of a so-called pin-ball machine known as “ Ascot Derby.”
It appears from the argument of both counsel on the appeal that the appellant was tried before the said City Court and a jury upon a charge of violating section 982 of the Penal Law. The defendant was acquitted.
