MEMORANDUM AND ORDER:
This is a seizure action brought under section 304 of the Food, Drug, and Cosmetic Act, 21 U.S.C.A. § 334, to condemn a quantity of the drug Ulcerine and a quantity of concentrate used in the manufacture of Ulcerine. Cause No. 70-H-880 was filed August 17, 1970, and Cause No. 71-H-31 was filed January 13, 1971. Each action alleges, in essence, that Ulcerine is a new drug which may not be shipped in interstate…
