The complainant, on January 10, 1959, was riding as a guest passenger in an automobile owned and. operated by James F. Cook, when the vehicle collided with an automobile operated by Frederick Downing. Thereafter, on January 13, 1960, A. B. Crittenden, an adjuster for Farm Bureau Mutual Insurance Co., herein referred to as "Insurer" or "Farm Bureau," after some negotiations with complainant, delivered to the latter, a draft of Farm Bureau in the sum of $17.00 payable to complainant.
