This is yet another in a series of cases concerning an obscure but heavily litigated consequence of the largest bank failure in Ü.S. history: the fate of Washington Mutual’s (WaMu) leases for real estate on which bank branches were as yet unbuilt at the time of the company’s collapse. In an earlier case addressing this issue, Excel Willowbrook, L.L.C. v.
