There was no legal evidence offered to support the alleged contract between Mr. and Mrs. Heilman. Mrs. Hellman and Mr. Oonnell were both incompetent witnesses. As against the representatives of a deceased person Mrs. Heilman cannot disclose the communications made to her by her husband.

It appears herein that during a period of twenty-five or more years prior to 1892 and inclusive of a few of the earlier months of said year Meyer Heilman was engaged in business in the city of Omaha as a dealer in clothing, the greater portion of the time both at wholesale and retail, but during the last five years exclusively the latter.
